within in the constitutuion and attendent documents (the declaration of
independence, the bill of rights, the federalist papers, etc.), the
definition of "the people" is individuals, that is the folk that make up
the general citizenry of the usa.

our government was not set up to be a democracy.  hence, the pledge of
allegiance: and to the republic for which it stands.  congress proposes
bills and passes laws.

the people are not the determining factor under the us constitution, it
is the constitution itself.
the people may amend the constitution but then the ammendment becomes
the constitution.

the rights of the federal government were greatly limited by the
constitution.
the rights of the states and the rights of the people were only limited
in a small number of ways.
  e.g., citizens must be 35 years of age or older
  e.g., states cannot mint their own money, stamps, etc.
  e.g., states generally reconize the actions of other states as
legitmate

I think what might be subject to a lot of legal wrangling is "what
defines 'the people'" in the context of lawmaking. We do not make laws
personally; we have proxies in the form of our elected officials. So if
our congressman votes in favor of a law, is that not "the people"
passing the law? If so, then anything passed by congress meets the
requirements of the 10th amendment.

Or not?
