No just stupid. They are bringing this on the basis of trade secrets.
It isn't a trade secret if it's public and they distributed the kernel
source themselves.

Part B, is even more unlikely. Novell, for whatever its reasons, put
the kibosh on that. Watch for the lawsuit between SCO and Novell over
what was actually transacted in that deal. Sontag's handwaving doesn't
make that go away.
