It is legal, though, in CA - and folks in cars *must* let them by.  Not
a question about being an asshole or not - it is specifically allowed
for in the traffic laws.  There are also other parts of the US where
this is legal - but I can't recall right now.

As for breakdown lane driving, that also is quite legal in many parts of
the country.  Rt95/128 and Rt93 in Mass. both have allowances for use of
the breakdown lane during heavy traffic hours.  PErfectly legal and
specificaly allowed for in the traffic code.

If it's legal, don't get heartburn over it.  There's nothing you can do
- and doing something can land you a sizeable ticket for reckless
driving.  As well as a sizeable boost in your insurance premium when the
claim is filed.  Relax and let it go.
