I think you're under the misapprehension that people will not do that which
is illegal. The size of our prison population bears eloquest testimony to
the fact that this is not the case.
In any case, whom would you prosecute? The sender is anonymous, and the
"beneficiary" of the spam, the website advertised, might have been "jobbed"
by a competitor.
Nope, you have to go after the ISP, or, if he's offshore, his domestic
correspondents.
