IANAL so I don't know.  

But I think a phone call from the FCC which regulates hams, might make the HOA lawyer think twice.  

They tried to ban satellite dishes, but Congress put a stop to that.

Of course, any Federal exemption would not stop the HOA folk, should they
decide, from condemning your actions, censoring you (fine and directives),
or suing you.  They can do more than "1 thing about it".  Living in a
community means compromises from time-to-time.
