Has anyone approached Ellison about this? 

Oracle has free (as in beer) versions of their database software for Windows 
and Linux, did they have one for Solaris? 

What he's doing is obvious, he's trying to reduce his expenses for hardware
for and software support and eliminate people selling old computers 
competing with his selling new ones.

He's also getting out of the mindset of give away as much as you can to
get market share which worked so well for SUN.

However, none of that precludes a hobbyist license and if he is approached
by someone with "a name" in the hobbiyst movement, for example someone who
has run SUN oriented mailing lists and web sites for years, he may
change his mind.

Or figure out a way to monetize it enough that it makes sense to everyone.
