The open sourced version of Darwin seems to be rather stale, and the
non Apple developers report that they believe it is because Apple
doesn't want people being able to use the open source version to
leverage OS X onto non Apple hardware.

It is?  I thought MS issued a statement that they wouldn't be adding EFI
support the 32bit version of Vista.

A lot of people would still bootleg windows at $50 I bet.  I don't know
that it effects your point at all.
