At least where I come from...

Of course, if you shoot said person with your own weapon, it could get
sticky (licensure, permits, etc).  However, if someone points a gun at
you, you take it away from them, and shoot them with it, things are a
little easier in the court system.  Assuming you didn't take the gun
away, then come back later and fill them with holes...
