In that case, it needs to be framed such that it includes pulling the 
wool over the USTPO to get a patent granted -with- prior art.  Let's 
see them try fighting that in court!

   "You violated our patent #nnnnnnnnnn" for a business model of getting 
a patent issued on an obvious idea with lots of prior art and extorting 
small companies with threat of litigation."

It's sort of like the "have you stopped beating your wife" question.  
They're damned either way that they answer.  If nothing else, it'd be 
interesting to see what sort of rejection letter the USTPO would send.
