you don't need a patch to do this. make sure volume management isn't running
(/etc/rc2.d/S92vold stop) or isn't probing your cdrom drive (/etc/vold.conf).

i use a yamaha cd-rw drive with cdrecord under solaris 7 with no problems. 
the patch you're thinking of addresses some bugs in the hsfs kernel module
and isn't neccessary in order to use a cd-r:
