It depends on the state. In some states (such as FL) you must do everything you
can to flee the situation before you can use deadly force. In others (like TN)
just the threat is enough, you don't have a responsibility to flee. Of course
having said that you must remember that no matter how justified you were in
shooting somebody expect to get a trip to jail, and have some legal expenses :(
